I might be reading this wrong, but my battery can charge to 88.43 WH but its design capacity is only 84.24. I have put 33 cycles on my battery.
Now I don't want to complain about having more capacity, but at the same time I don't want my laptop to explode on my lap.
My battery HASN't been recalled, but it makes me wonder if there is some sort of sensor defect that is making this happen.
A few weeks ago I was pretty peeved when the system told me the battery had been charged to 107% capacity, and that might be related.

Battery's full charge capacity higher than design capacity?

The T23 I'm currently using has a battery first use date of 2000-06, a cycle count of 34 (!), a design capacity of 38.88Wh and a full charge capacity of 39.14Wh. I'm getting a little over 2 hours of run time using wireless and simple web browsing. The battery MaxiMiser gauge has never gone above 100%.
Like you, I'm not complaining about the little extra charge. Nor am I worried at all about it. I believe that the information concerning the design capacity is pre-programmed into a memory chip inside the battery pack. With slight variations in manufacturing, a 5% difference between the two values is not that significant.

Most if not all Thinkpad batteries I've used exceed their design capacities a little bit when new. It's probably done on purpose to make the customers happy. It's nothing to worry about.
